1) Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of BabyPhoto ("the App", "Service"). By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree, do not use the App.

2) Paid Service

The App is not free to use. Access to some or all features requires payment, subscription, or in-app purchase, as presented inside the App or app store listing.

All payments are handled through applicable platform billing systems and third-party subscription infrastructure.

3) Eligibility and Account

You must be legally capable of accepting these Terms in your jurisdiction. You are responsible for maintaining the security of your device and account environment.

4) License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.

You may not:

Reverse engineer, decompile, or attempt to extract source code, except where allowed by law.
Use the App for unlawful, abusive, or infringing activities.
Interfere with the App's operation, security, or integrity.

5) AI Features

The App includes AI-powered features and may use third-party AI services including:

Google Gemini
OpenAI
Anthropic

By using AI features, you acknowledge:

Outputs may be inaccurate, unexpected, or unsuitable for sensitive decisions.
You are responsible for how you use AI outputs.
You must not submit unlawful, infringing, or harmful content.

6) User Content

You retain ownership of content you submit. You grant us and our processors a limited license to host, process, and transmit your content solely to provide the Service.

For AI features, related images may be stored in Firebase Storage for up to 30 days and then deleted.

7) Subscriptions, Billing, and Cancellation

Subscription terms (price, duration, trial, renewal) are shown before purchase.
Unless canceled before renewal, subscriptions may auto-renew per store rules.
Refunds, cancellations, and billing disputes are handled by the platform where you purchased (for example, Apple App Store or Google Play), subject to their policies.

8) Intellectual Property

The App, including software, branding, and non-user content, is owned by or licensed to the publisher and protected by applicable intellectual property laws.

9) Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

10) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising from use of the App.

11) Termination

We may suspend or terminate access to the App if you violate these Terms or if needed to protect the Service, users, or legal rights.

12) Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms. Continued use after updates means you accept the revised Terms.

13) Governing Law

These Terms are governed by applicable laws, excluding conflict-of-law principles, unless mandatory local consumer law states otherwise.
